Module Overview
Module 2 provides participants with a comprehensive overview of the legal framework governing whistleblower protection systems within the European Union. The module focuses primarily on Directive (EU) 2019/1937 and introduces participants to the legal obligations, procedural safeguards, and reporting mechanisms required for effective whistleblower protection.
The module begins by examining the objectives and scope of Directive (EU) 2019/1937. Participants explore the reasons behind the adoption of the Directive and its importance in harmonizing whistleblower protection standards across EU Member States. The training explains how the Directive seeks to improve protection for persons reporting breaches of Union law while strengthening transparency, accountability, and enforcement.
Participants are introduced to the material and personal scope of the Directive. The module explains which areas of Union law fall within the scope of protection, including:
- public procurement,
- financial services,
- anti-money laundering,
- environmental protection,
- public health,
- consumer protection,
- privacy and data protection,
- and other relevant sectors.
The module also addresses the categories of individuals protected under the Directive, including:
- employees,
- former employees,
- contractors,
- shareholders,
- applicants,
- facilitators,
- and persons connected to reporting persons.
A substantial part of the module focuses on reporting channels and reporting procedures. Participants examine the differences between:
- internal reporting,
- external reporting,
- and public disclosure.
The module explains reporting hierarchies, procedural safeguards, and the conditions under which reporting persons may benefit from legal protection. Particular emphasis is placed on confidentiality obligations, feedback mechanisms, reporting timelines, and the importance of safe and accessible reporting channels.
Participants are also introduced to the concept of protected disclosures and learn how to distinguish protected whistleblowing reports from:
- workplace grievances,
- interpersonal disputes,
- malicious allegations,
- and non-protected complaints.
The module further explores legal protection mechanisms related to retaliation prevention. Participants examine the various forms retaliation may take, including:
- dismissal,
- demotion,
- intimidation,
- harassment,
- reputational damage,
- exclusion,
- and procedural pressure.
Special attention is given to practical implementation challenges identified within the VoiceGuard project research, including:
- inconsistent legal interpretation,
- weak operational procedures,
- low awareness of legal obligations,
- and organizational uncertainty regarding handling of reports.
Interactive exercises are integrated throughout the module to strengthen practical understanding of legal principles. Through scenario analysis, legal qualification exercises, reporting route simulations, and reflection activities, participants are encouraged to apply legal concepts to realistic situations.
The scenario “Is This Protected?” allows participants to assess whether specific disclosures fall within the scope of whistleblower protection and determine the most appropriate reporting routes and procedural safeguards.
By the end of the module, participants acquire practical understanding of the legal and procedural foundations of whistleblower protection systems and are better prepared to apply legal principles within organizational and institutional contexts.
